Red Apple Lipstick provides color cosmetics and related accessories designed and labeled for external cosmetic use only, in compliance with the U.S. Food, Drug, and Cosmetic Act (FD&C Act) and applicable U.S. cosmetic regulations.

Our products are not medical treatments and are not intended to cure, prevent, or treat any disease or medical condition. Products should be used only as directed on the packaging. Do not use on children under 13, apply to broken or irritated skin, or ingest products (e.g., lip products). Consult a physician before use if pregnant or nursing.

3. Ingredient Disclosure and Allergies

5. Shipments and Delivery

All shipments are made FOB Origin, Freight Prepaid & Add, unless otherwise specified. Title and risk of loss pass to Buyer upon shipment. We provide tracking information and estimated delivery windows where available. Seller is not liable for delays or losses caused by carriers, customs processes, natural disasters, acts of God, supplier delays, government actions, or other events beyond our reasonable control. For international orders, you are responsible for customs duties, taxes, and compliance with local import and cosmetic regulations.

6. Refund Policy

We offer a 100% money-back guarantee for eligible returns made within 30 days of delivery, provided products are unused, in original condition, and accompanied by proof of purchase. Refunds will be issued to the original payment method within 10 business days of receiving the returned product. 7. Limited Warranty and Disclaimers

Seller warrants its products against manufacturing defects for 90 days from the date of delivery. This warranty is limited to replacement of the defective product or refund of the purchase price, at Seller’s sole discretion.

In no event shall Seller be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to personal injury, allergic reaction, loss of profits, business interruption, or emotional distress—even if advised of the possibility of such damages. Seller’s total liability for any claim shall not exceed the purchase price of the product giving rise to the claim, except where prohibited by law.

8. Product Safety and User Responsibility

Our cosmetics are manufactured under industry-standard quality control. Product performance may vary due to environmental conditions, storage, or individual physiology. Store products in a cool, dry place away from direct sunlight to maintain quality.

You agree not to:

These Terms and any dispute arising from them shall be governed by the laws of the State of Texas, without regard to conflict of law principles. All disputes shall be resolved exclusively through binding arbitration in Montgomery County, Texas, under the rules of the American Arbitration Association, except where such arbitration conflicts with applicable consumer protection laws. Each party shall bear its own costs and attorneys’ fees, unless otherwise required by law or in cases of frivolous claims, where the prevailing party may seek reasonable costs. You waive any right to participate in a class action or jury trial, to the extent permitted by law.
